ARCA ADA Policy
ADA NON-DISCRIMINATION POLICY
Title III of the Americans with Disabilities Act (“ADA”) prohibits exclusion, segregation, and unequal treatment of individuals with disabilities.
In compliance with the ADA, ARCA will provide reasonable accommodations to individuals with disabilities so that they may access its services and have equal opportunity to participate in its programs. An individual with a disability may not be excluded from participation in ARCA’s programs unless the individual’s participation would result in a direct threat to the health or safety of others, based on an individual assessment that considers the particular activities and the actual abilities of the individual. Reasonable accommodation will be provided unless it would pose an undue burden for ARCA or fundamentally alter the nature of its programs or the provision of its services.
Reasonable accommodations may include modification to ARCA’s policies, practices, and procedures, removal of architectural barriers when that is readily achievable, and auxiliary services to provide effective communication. All requests for reasonable accommodation should be directed to the Director of Nursing, the Chief Executive Officer, or the Chief Operating Officer.
All ARCA employees, including those involved in the admissions process, will receive training on ADA compliance. If during admission, or at any time during an individual’s participation in ARCA’s services, a need for accommodation based on disability is observed or requested, that observation or request will be promptly forwarded to the Director of Nursing, the Chief Executive Officer, or the Chief Operating Officer, so that it may be addressed in a timely manner.
Retaliation against any individual based on disability or need for accommodation is strictly prohibited.
